AMC Contract
Annual Maintenance Contract
Definitions:
Usha Shriram Enterprises Private Limited referred as "USEPL".
Annual Maintenance Contract "AMC"
Under this contract,
USEPL undertakes to maintain your Waterguard(D/E)/Reverse Osmosis installed at the
above address. This contract provides for periodical service to the water-purifier
and free replacement of spare parts subject to the terms and conditions
mentioned hereafter.
Services covered by
the contract are as follows:-
1. Two periodical
service visits per year during the period of contract mentioned above, when the
Waterguard(D/E)/Reverse Osmosis will be thoroughly checked, cleaned serviced
and adjusted.
2. Any additional
visits during the contract period, as and when required, in the event of any
breakdown/malfuntioning of the equipment on the intimation in this regard by
the customer.
3. Free Replacement
of filter cartridge will be made once every year (maximum) depending on the
condition of the existing cartridge during the service contract period.
4. Free Replacement
of worn-out/exhausted parts, including Ultra Violet Lamp with new/rectified
spares during the periodical servicing or breakdown visits during the service contract
period.
TERMS AND CONDITIONS
OF THE CONTRACT :
A. The contract shall
not cover visits/replacement of parts under the following circumstances :-
a. Damage caused to
the Waterguard(D/E)/Reverse Osmosis due to accident, fire, mishandling,
breakage, improper or negligent use, tempering, leakage from pipes, floods,
riot, pest, etc.
b. Damage caused to
the equipment due to failure to observe the guidelines in accordance with the instruction
manual.
c. Defects due to
usage of non-recommended spares.
d. Visits for
customers re-training or for re-installation.
e. Defects/failures
resulting from servicing/repairs done by a person other than the authorised
representative of USEPL.
f. Where this
equipment is under use for more than 8 hours a day continuously, unless
otherwise agreed in writing by USEPL.
g. Inspection &
test report of the Company's office/service centre will be final and binding
for determining defects, repairs required or certifying working of the product.
h. In any case
Reverse Osmosis membrane is not covered in AMC. It can be replaced as and when required
against payment.
B. Since under the
terms of this contract the company is liable to supply you free replacement of
spare parts in certain circumstances, Sales Tax wherever liable will be borne
by USEPL. However, the spare parts replaced will be the sole property of USEPL.
C. Services under
this contract exclude the following :-
a. Painting of the
body, top and bottom panels, and anodising the treatment chambers and
electronic housing.
b. Chrome plating of
the nuts and other styling decorative materials.
D. For repairs
necessitating the removal of the Purifier or any parts thereof, to USEPL
Service Centre or factory,
there shall be no
additional charge for the labour. However, in such cases incidental expenses
incurred like frieght, packing, insurance, octroi, etc. will have to be borne by
the customer.
E. The equipment must
be in good working condition. The same to be certified by authorised
representative of USEPL, before this contract becomes effective. The customer
shall pay the necessary charges in the first instance for rendering the
equipment so workable, for which USEPL will submit an estimate for approval.
This clause does not apply if a contract
is renewed from the
next day of date of termination of the warranty period or previous contract
period.
F. The equipment
should be made available for servicing as and when our Service Technician/
authorised Franchisee
Technician calls on his periodical servicing visit. Failure to do so will be
treated as a service
rendered and no refund shall accrue on this account.
G. Every visit by our
Service Technician/authorized Franchisee Technician will be made within
reasonable time from receipt of a complaint for breakdown of the equipment and
will be made only during working hours of our Service Department.
H. USEPL shall not be
liable for death/injury consequential damages to any person or loss/
damage to any
property caused as a result of equipment failure breakdown or accident or fire
or
any other
circumstances beyond the control of USEPL.
I. In order to enable
USEPL to discharges its obligation under this contract, the customer shall
notify in writing any change in his adress within 10 days of such change. In
dafault whereof, USEPL shall not be obliged to perform its obligations under
this contract till it receives such an-intimation from the customer. In such an
event the removal and re-installation of the Waterguard unit will be done at an
additional cost as per the rates prevailing on that date.
J. This contract is
not terminable before the expiry period nor is it transferable in the event of
resale/gift to any other person.
K. The service
contract is offered only within the municipal limits of your city. However, an
additional lumpsum amount of Rs.25/- will be charged extra for each visit made
beyond these limits but within the metropolitan area and will have to be paid
in cash to the Service Technician attending for which a cash memo/bill will be
given.
L. Contract charges
are payable by online payment favouring
USHA SHRIRAM
ENTERPRISES PVT. LTD. in
advance and payment
shall accompany the signed copy of the contract.
M. Renewal of the
Service contract after its expiry will be at the sole discretion of USEPL.
N. It shall not be
the responsibility of USEPL to send any reminder or any such communication to
intimate the customer either in nature of intimating the expiry of the contract
or in the nature of renewal notice of the contract. The onus of renewing the
contract rests with the owner.
O. In the event of
any complaint, please quote your name, address and contract number.
P. This contract sets
out all the terms & conditions, of which USEPL agrees to service the
equipment & cancels and supersedes all prior agreements, undertakings or
arrangements, oral or written between the parties on the subject matter.
